Unless expressly stated otherwise, products sold by AMCORP are intended solely for lawful use. Certain products offered by AMCORP are designed for vehicles used exclusively in closed-course competition, racing, off-road recreation, or other applications where permitted by applicable law.
Customers are solely responsible for determining whether the purchase, installation, possession, or use of any product is legal in their jurisdiction and for their intended application.
Compliance With Federal, State, and Local Laws
It is the customer's responsibility to understand and comply with all applicable federal, state, provincial, and local laws and regulations, including emissions, environmental, vehicle registration, inspection, and safety requirements.
AMCORP does not represent or warrant that any particular product is legal for use on public roads or highways in every jurisdiction.
Customer Responsibility
By purchasing products from AMCORP, you acknowledge and agree that:
- You are responsible for ensuring the compatibility of all purchased products with your vehicle.
- You assume all risks associated with installation and use.
- You are responsible for obtaining any required inspections, certifications, or approvals required by law.
- You understand that certain products may not be legal for use on emissions-controlled vehicles operated on public roads.
- You will comply with all applicable laws governing your vehicle and its operation.
Professional Installation Recommended
Many products sold by AMCORP are intended for experienced enthusiasts or professional installers.
Improper installation, calibration, tuning, or operation may result in:
- Engine damage
- Transmission damage
- Drivetrain failure
- Vehicle malfunction
- Personal injury
- Property damage
Professional installation and tuning are strongly recommended.
Performance Products
Performance modifications inherently increase mechanical stress on vehicle components.
AMCORP makes no guarantee that modified vehicles will achieve any specific horsepower, torque, fuel economy, reliability, drivability, emissions compliance, or durability.
Vehicle condition, maintenance, supporting modifications, fuel quality, environmental conditions, and driving style all affect results.
Assumption of Risk
Performance modifications involve risks that cannot be eliminated.
By purchasing or using products sold by AMCORP, you voluntarily assume all risks associated with installation, tuning, operation, maintenance, and use of those products.
Limitation of Liability
To the fullest extent permitted by applicable law, AMCORP, its owners, employees, affiliates, and representatives shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to the purchase, installation, use, misuse, or inability to use any product sold by AMCORP.
This includes, without limitation:
- Engine failure
- Transmission failure
- Turbocharger failure
- Fuel system damage
- Towing expenses
- Rental vehicle costs
- Loss of use
- Lost profits
- Business interruption
- Property damage
Where applicable law does not permit certain limitations of liability, those limitations apply only to the maximum extent permitted by law.
Product Warranty
Unless otherwise expressly stated in writing, products are provided "AS IS" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Any manufacturer warranty remains solely the responsibility of the original manufacturer.
No Guarantee Against Mechanical Failure
No automotive performance product can eliminate the possibility of mechanical failure.
Customers acknowledge that vehicle modifications may reduce component lifespan or increase maintenance requirements.
AMCORP is not responsible for failures caused by abuse, improper installation, insufficient supporting modifications, poor maintenance, improper fuel, excessive operating conditions, pre-existing mechanical issues, or normal wear and tear.
Inspection Before Installation
Customers are responsible for ensuring their vehicle is mechanically sound before installing any performance product.
Installing performance products on a vehicle with existing mechanical issues may increase the likelihood of failure.
Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless AMCORP, its owners, employees, affiliates, agents, and representatives from and against any claims, damages, liabilities, judgments, costs, and reasonable attorneys' fees arising from your purchase, installation, modification, operation, resale, or misuse of products purchased from AMCORP, except to the extent caused by AMCORP's own negligence or other liability that cannot legally be disclaimed.
Governing Law
These terms shall be governed by and interpreted under the laws of the State of Arizona, without regard to its conflict of law principles.
Acceptance
By purchasing, installing, or using any product sold by AMCORP, you acknowledge that you have read, understood, and agree to this Off-Road Use, Emissions Compliance & Liability Disclaimer.
